Terms and Agreements

1. I understand that training session packages must be paid for in full before training starts.


2. I understand that once I have purchased a training package, I will have 4 weeks to complete my sessions. I will not be reimbursed for unused sessions. (Please take this into consideration when purchasing personal training packages and rescheduling appointments.


3. I understand that SMB Fitness LLC does not have contracts. I can purchase a monthly subscription or I have the option to purchase training per session.


4. I understand that all cancellation requests for monthly memberships require to be submitted a minimum of 30 days prior to the next billing date to ensure the cancellation of automatic

payments. There are no prorates available and you will be subject to payment for the following month if your request is less than 30 days from the next scheduled billing cycle (Cancellation request: https://www.smb.fitness/cancel)


5. I understand that the personal trainer must be notified of cancellation 4 hours in advance of scheduled sessions. (You must receive verbal or text confirmation of cancellation from the trainer. If you do not appear for a scheduled appointment or fail to give 4-hour notice, you will be voided for a session. The personal trainer will only wait 15 minutes for late arrivals. Please call if you are going to be more than 5 minutes late for a session)


6. I understand that each training session is up to 60 minutes. (Clients are expected to begin working out at the start time of the scheduled appointment. A late start time does not entitle a client to a session longer than the scheduled appointment)


7. I understand that SMB Fitness does not promise any results, however, have seen several success stories from clients with different fitness goals and fitness levels following the same fitness programs.


8. I understand that SMB Fitness LLC does not manufacture or sell any vitamins, food

products, sports drinks, or nutritional supplements.


9. I understand in order to see and feel changes in my body that it will take my commitment and hard-earned work during and after training. (To maximize results, it is important to follow a quality program on a consistent basis with clean eating habits)


10. I fully understand that the program may be strenuous and choose to participate completely voluntarily. I accept the responsibility for my health and any resultant injury or mishap that may affect my well-being or health in any way. All members are advised and encouraged to consult with his/her personal physician before beginning use of fitness or

exercise facilities and/or equipment or participating in any physical activity.


11. I understand that it is my responsibility to update my payment method if needed for any reason before I am billed.


12. I understand that any pictures(not including transformation photos), audio, or visual recordings taken of him/her in connection with SMB Fitness training services can be used for publication, promotion, and advertising without any additional consent and compensation at this time or any other time.


The novel coronavirus, and the disease caused by it, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. SMB Fitness LLC has put in place preventative measures to reduce the spread of COVID-19; however, they cannot guarantee that you or your guest will not become infected with COVID-19. Further, attending training could increase your risk of contracting COVID-19. By signing this agreement, I understand the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending SMB Fitness a training program that may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at MVPR may result from the actions, omissions, or negligence of myself and others, including, but not limited to, SMB Fitness employees, volunteers, and program participants and their families.


13. I agree that in the event that I suspect I've been exposed to or infected by COVID-19 anywhere or at the training location I elect to seek testing and/or treatment as a result therefrom, I will be responsible for payment of any and all medical services and testing services.


14. I understand that in order to receive credit for my training due to COVID-19, I must have proof of my positive COVID-19 test results.


15. I understand that I must notify the trainer as soon as I receive a positive COVID-19 test.
